Terms of Service — TEAMWAVE Artist Upload Platform

1. Scope and Service

These terms of service apply to the platform at `https://artists.teamwavefm.de` (hereafter „Platform").

The Platform is a free offering by [TEAMWAVE FM — operator details see imprint] (hereafter „we") to musicians and artists (hereafter „Artists") to upload their music, enter metadata, and submit for broadcast in TEAMWAVE Radio.

Service includes:

• Free signup via email or Nostr
• Profile management (name, bio, links, payout destinations)
• Upload storage for audio and cover art (up to 200 MB per file)
• Curation of submitted works by our team (no guarantee of broadcast)
• Detailed feedback if rejected
• Content removal on request

2. No Right to Broadcast

Submitting a work to the Platform grants no right to broadcast on TEAMWAVE Radio. We review each submission and make an editorial decision. This decision is at our discretion and does not require justification, except where rejected (see Section 4).

3. User Responsibility

You warrant that:

• You created all content yourself or have full rights to use it
• All information provided is true and complete
• You are an adult (18+)
• You accept these terms

You are solely responsible for all content you upload, including music, cover art, and metadata.

4. Moderation and Removal

We reserve the right to remove content or suspend your account if:

• Copyright infringement is present or suspected
• Content is illegal or violates applicable law
• Content violates these terms

If we remove content due to alleged infringement, we will provide brief notice. You may submit a complaint via email to info@teamwavefm.de.

5. Liability and Warranty

We provide the Platform „as-is" without warranty. We do not guarantee:

• Uninterrupted availability
• Protection against data loss or corruption
• Income or broadcast placement

Our liability for damages arising from your use of the Platform is limited to fees paid (in this case, 0 EUR).

6. Data Protection and Security

Your personal data is processed per our Privacy Policy. We store:

• Email and login credentials
• Artist profile (name, bio, links)
• Uploaded audio files and cover art
• Payout destinations (encrypted)
• IP address and User-Agent when accepting the rights declaration
• Server logs (14 days)

Your payout destinations (IBAN, PayPal, Lightning address) are encrypted and only decrypted for payout or verification.

7. Payment and Payout

Phase 1 (current): Listeners pay directly to the recipient's Lightning wallet you specify. We do not hold, manage, or collect money. Your payout destinations are for record-keeping and statistics only.

Later: IBAN and PayPal can already be registered now. Payouts through these methods only start once TEAMWAVE FM has set them up with a licensed payment partner; we will inform you about conditions and minimum amounts beforehand.

All payments are made without guarantee. We assume no liability for failed or delayed payments.

8. Copyright and Licensing

By uploading content, you grant us a simple, worldwide, non-exclusive right to use it for:

• Broadcast and web streaming (including corporate and event channels)
• Reproduction, caching, and transcoding
• Public promotion (title, artist name, cover, bio)
• Short excerpts for moderation and promotion

You may revoke this right at any time; revocation is effective immediately (not retroactively).

9. Withdrawal and Deletion

You may delete your account at any time. Upon deletion:

• All uploaded content is removed
• Your profile is deactivated
• Payout destinations are deleted

We may retain the following data if legally required (e.g., for tax purposes):

• Audit logs (account lifetime + 3 years)
• Payout history and receipts
• Rights declarations with timestamp (as evidence)

10. Duration and Termination

This agreement begins upon signup and runs indefinitely. You may terminate at any time; we may terminate for cause (breach, legal requirement).

11. Severability

If any provision of these terms is invalid, all other provisions remain in effect.
